Ariana Biermann Fights DUI Charges – Says Police ‘Illegally’ Obtained Evidence

   

Ariana Biermann isn’t going down without a fight. The 22-year-old is fighting back against her 2022 DUI case. She demanded that the court shelve some evidence the prosecution hoped to use against her. Ariana now insists that the evidence in question was obtained illegally.

Ariana basically hopes a jury can resolve the case against her after she pleaded not guilty to six misdemeanor counts. The influencer was arrested on August 13, 2022, after the Forsyth County Sheriff’s Department initiated a traffic stop. According to In Touch, Ariana’s lawyers are arguing that “sufficient facts did not exist to support even an articulable suspicion that Ariana was under the influence of alcohol or drugs, or that any other criminal activity was underfoot.” Ariana’s lawyer has gone as far as to argue that she did not commit any violations prior to being detained. 

In the court documents, the lawyer noted, “Ariana further shows that this initial detention was an unlawful warrantless seizure. It was not supported by probable cause or articulable suspicion, violating Ariana’s rights under the Fourth Amendment to the Constitution of the United States.” Ariana is claiming the “evidence was illegally obtained.” The TV star is also asking that any evidence “from the field sobriety tests be tossed over her concern that the officer may not have been properly trained.” The prosecutors have yet to respond.

Ariana is fighting six charges brought against her by the State of Georgia. The charges are “driving under the influence of multiple substances and driving under the influence of alcohol.” As well as “possession of drug-related object due to her unlawfully possessing a vape pen with THC cartridge, improper turn, failure to obey signs or control devices, and underage possession of alcohol.” The Sheriff’s Department initially arrested Ariana for an improper lane change and underage alcohol possession. Also, at the time, Ariana told police she had not been drinking.
