When Erika Jayne filmed Season 14 of The Real Housewives of Beverly Hills, it seemed that she was confident that her legal troubles were ending. Despite being embroiled in several civil suits, including being sued in two separate states by the co-founders of the Marco Marco costume design company, there was hope that those cases would be dismissed.

A clerical error by her lawyer, and close friend, Jim Wilkes, cost her the chance to dismiss the case entirely. It was reported that the attorney failed to file the motion to dismiss correctly.

Now, Erika is facing default on the Florida case. The stress of it all is getting to the RHOBH star, Jim exclusively told The U.S. Sun. She might forfeit over $300,000 due to his lack of attendance at a court hearing on the suit brought by Marco Morante.

Marco’s business partner is suing Erika in California court. They are presenting a united front in fighting back her accusations that their company illegally overcharged her up to $900,000. The RHOBH star denied any wrongdoing.

Erika’s attorney, who is working pro-bono, said that he is “fighting all the way” to extricate his client from the situation.

“My staff made a mistake. I am in the process of winding down my practice to focus on fewer cases,” Jim explained. “All I’m going to say now is, ‘Your honor, I apologize.’ I’m going to file a new motion and go from there.”

Erika’s attorney thinks they have a good chance of winning should the lawsuit move forward

Despite what the judge may decide to do, Erika’s lawyer is confident that Marco’s case is weak. On the odds of Marco Marco winning, Jim said, “They have no chance. I’m doing everything I know how to do to end this.”

As for how Erika is doing amidst this legal setback, the attorney admitted that she is “dealing with a lot of stress.” The RHOBH veteran also had to put her podcast Diamonds in the Rough podcast on hold. Her cohost, Teddi Mellencamp, fights for her life against Stage 4 cancer.

“She’s got a close friend that she’s done the internet podcast with who’s got an incredibly difficult health issue. That’s been very difficult for Erika,” the lawyer added.
