Penny Davidi sued the 'Vanderpump Rules' stars for allegedly not upholding the terms of their written partnership. Now Madix and Maloney are calling for a trial by jury

Ariana Madix and Kate Maloney are responding to a lawsuit brought against them by a former employee.
In July, chef Penny Davidi sued the Vanderpump Rules stars for not upholding the terms of their written partnership, according to the filing obtained by PEOPLE. Almost two months later, Madix and Maloney answered the complaint.
In the lates documents obtained by PEOPLE, the two business owners “deny each and every material complaint” in Davidi’s filing. They also deny that the former employee is “entitled to any relief whatsoever.”
Madix and Maloney provide six affirmative defenses, including failing to allege a justiciable controversy. They also claim that Davidi is asking the court to give an opinion about "hypothetical facts."
The duo are requesting a trial by jury.
In a statement to PEOPLE, Davidi's lawyer, Jonathan Borsuk, said that his client "very much look[s] forward to having their day in Court."
Maloney confirmed in April that they had parted ways with Davidi, according to Bravo.
The chef's original complaint stated that in June 2023, the trio agreed that Davidi possessed 10% of the partnership, serving as the “COO/Director of Culinary.” The chef would be paid $7,500 a month, which would ultimately increase to $10,000 in January 2024, per the complaint. It was contingent on Davidi helping run Something About Her, which she claims she has.
Davidi alleged Madix and Maloney are denying the terms of the original partnership.
Something About Her opened in West Hollywood in May after permitting issues and other logistics caused delays. Madix and Maloney first announced plans to open the shop in 2022.
