Kroy Biermann requests complete control over the sale of the Georgia mansion he shares with ex Kim Zolciak.
The former NFL linebacker, 38, claims that Zolciak, 46, is refusing offers on their $3.95 million home despite the property being at risk of foreclosure in October 2024, according to legal documents obtained by PEOPLE and first reported on by TMZ.
In the documents filed on Aug. 30, Biermann claims that the The Real Housewives of Atlantaalum's “frivolous spending” has left them with one asset, their shared marital home. The property has been nearly foreclosed on “at least two times” before, per the documents.
Biermann alleges that Zolciak makes “claims of having no money,” however she “buys $400 bottles of wine by the case” and “has continued to purchase clothes, undergo plastic surgery, engage in online gambling and go out almost every night.”
The documents claim that Zolciak's "complete disregard " of the former couple's "financial situation will have devastating consequences" for them and their children.
They share Kroy "KJ" Jagger Jr., 13, Kash, 12, and twins Kaia Rose and Kane Ren, 10. Zolciak also has two older daughters from a previous relationship, Brielle, 27, and Ariana, 22, whom Biermann legally adopted.
Biermann is asking the court to "force the sale of the home" for a price that he finds acceptable and "remove [Zolciak] from any decision-making process.”

Biermann also claims that Zolciak said “she didn’t care if the home went into foreclosure.” She allegedly doesn’t want to accept an offer less than $3.85 million for the property because then she wouldn’t “have enough money to purchase a home” of her own.
However, Biermann’s line of credit is the one that will be impacted as his name is on the mortgage and deed while Zolciak’s name is only on the deed, per the filing.
According to the documents, “there is a $1.32 million lien against the home from the IRS” and their mortgage lender “is owed approximately $2.2 million.” They also owe $250,000 for another lien in addition to three attorney’s liens.
Zolciak has since responded to Biermann, telling TMZ on Monday (Sept. 9) that she pays "all the bills" in their home. She called his latest legal filing "a game," and alleged that he said if she ever divorced him, "he would destroy me publicly." She also claimed that he was attempting to reconcile, however, she isn't interested.
She said that she's willing to sell the home, however, she asked, "Who would take a $3.5 million offer on a $5.5 million appraisal?"
Zolciak and Biermann first put the home on the market for $6 million in October 2023, nearly two months after Biermann filed for divorce from Zolciak for a second time in August 2023. They have cut the price several times since. They first brought the asking price down to $5.5 million in December 2023, then to $4.5 million in January 2024, and again to $4.2 million in June 2024.
The mansion, which they bought in 2012, features seven bedrooms, a six-car garage, billiard and arcade rooms, a gym with a private massage room, a 500-bottle walk-in wine cellar, a heated pool, and a home theater, according to the listing on Zillow. The property is spread across 1.78 acres of land.
In August, a source familiar with the property told PEOPLE the home is worth far more than the current $3.95 million asking price.
"It’s an incredible deal for a house that size in a neighborhood that beautiful,” the source said after noting that the home was appraised for $5.5 million. "I can’t imagine it’ll be on the market that much longer."
